I;m sad to say I'm a customer of Peak 5 and have been for many years with a car that is so not worth what I am paying. However, I reached out to Leona today (July 15, 2008) to come up with type of payment plan until I got back on my feet and started my new job. And this is what the lovely Leona had to say Why don't you go take a pay day loan, or why don't you go to a pawn shop and sell something in your house.I was SHOCKED and asked if she was serious. Now mind you I just offered to pay the payment this month and the other half at the first of the month, she said they didn't accept payments. So, we went around again on my options and when I said I couldn't do this or that, she threatened me and said well, you need that car don't you? Like they were going to come get it, if I didn't make a payment.

I am so over this company and the way they mislead and threaten their customers. When I had some financial problems 3 yrs ago I called and again the girl on the phone told me to watch out, my car might not be in the parking lot when I left work. I worried and worried for months that my car would be gone after work. The stress was HORRIBLE and totally uncalled for.

This company has nothing but a bunch of cons and thugs working for them.

I'm not sure if the law applies the same in Florida, but in Colorado, you have to be three plus months delinquent on your car loan payments before the repo process can be put into place. As well, they need to have a court order saying they are allowed to reclaim the vehicle, and notify the local law enforcement agency. They do not have to notify you prior to repossession. However, you'll be getting a lot of phone calls and letters in the mail, which would tip you off that it will be soon.

As for the payment arrangements. Pay what you can when you can, and keep a log of it. They are within there rights to hold the payments until a full payment has been made, and to apply any late charges/fees to it.

Don't feel bullied by them. Tell them you are sending a payment for X-amount, and get the name of the person you're speaking with, and note the date and time. Keep a track of all payments sent, and let them know when you have made a full months payment, so they can apply it to your account properly.

Your credit will take a hit for being late, but at least your paying.
