After paying off my car 6 years of payments at $422.00 monthly never missed a payment I was paying so much I forgot in 2009 it was time to stop paying however between when Triad or roadloans went out of business some how they were transferred to Santander Consumer USA they did not tell Stander the car was paid off every since November 2009.  I gave them a call and told them what  had happen at my surprise they told me I still owed 8,000.00 they snatched my car in 2009 saying no payment I continued to fight them about my car being paid for.  They did not pay me any attention I filed complaints like everyone told me to file a complaint with my district Attorney's office.  At my surprise again the District Attorney's office did so little about the situation Santander reprossed the second time and did not tell me where the car was so I called the Maryland Police department they told me it was at American Recovery when I called  them they said not  here try another company called L&S in calling that company I gave them the description of the car and they said the car was auctioned off April 13th with all my personal belongings still in the car and my tags were still on the car another point the car was seven years old and they said the remaining balance was $6,000.00 as if I never paid on the car at all.  It's a 2004 Altima with a lot of defects in remember the car is seven years old and they repossed it in the middle of the night the lady told me over  the phone they got it 3:45am where's there no one around to stop them they are perputrating a finance company that's how they got on the property saying they had a repossion they ought to stop lying because they are debt collectiors that cannot be stopped the untouchables because its a lot of people on the net who reported them as bums.  This company never financed my car and I paid the contract I was on off.  five people in the company claim they were checking into it due to they have me down as buying the care in 2006 when I boought the car in 2004 paid on it until 2009 I also paid to get the car back $1,00.00 and reprocession fees up to $400.00 and this is how much people care about poor people living in America and paying their bills and still get robbed of their property if there is in lawyers or anybody who will take a stand against these crooks with Books please help some guy name Micheal Coyer told me my car was not in repossession he was calling me like a stalker tellling me all kiinds of lies of where he live in Texas.  It's debt collection company every place I wrote did nothing please rip off report help me get my car back my son got up to take his kids to day care that morning and it was No Car Thanks to Santander Consumer USA  PS fraudulent contract with some foney name at the bottom of a zerox signature something I never signed and lord knows who is Milton Washington I paid well over 35,000 on the car and the contract was 14,000.00 finance and when I called them they said my payments was going to an electronic internet where is I didn't have a payment book. I started off paying 422.00 monthly.  with all the repairs made on the used car from Enterprise car rental they need to be sued as well.  The reason why this report had taken so long to be written I had a stroke and lost some of my eye sight behind this my pressure went up real high and I got very sick and went into depression.  Help me get back what the Devil Stole from me.

What?

AUTHOR: Tagurit - (USA)

POSTED: Monday, February 06, 2012

I'm confused.  Do you not  have the original purchase contract which would have clearly stated the principle, the interest rate, the # of payments, etc. etc.?   Do you not have records of each and every payment you made - when the check cleared your bank account, etc.   I am surprised the DA did nothing if you had this level of evidence or documentation.

SCUSA it is what it is......

AUTHOR: SCUSA-Anonymous - (United States of America)

POSTED: Tuesday, May 17, 2011

Santander Consumer USA, Inc ("SCUSA") is alot of things. I don't know where to begin with your situation. Are you in the State of Maryland?
If you are, SCUSA is required by law to send you a Right to Cure letter before they pick up your vehicle.

If you didn't get one, report this information to the Department of Labor, Licensing Regulation ("DLLR"). They are regulated by DLLR and the Federal Reserve Bank (FRB).

After they repossessed your car, did you receive a notice? I believe in the state of Maryland the notice would be titled "Notice of Intent to Sale" or something similiar. Basically the notice tells you where the vehicle is, the date and time of sale. The Maryland NOI letters are all inaccurate and in violation of Maryland's Annotated code.

The NOI must containt the following:
(1) The right of the buyer to redeem the goods, and the amount payable for them;
(2) The rights of the buyer as to a resale, and his liability for a deficiency; and
(3) The exact location where the goods are stored and the address where any payment is to be made or notice delivered.

If this information is not included in your NOI, SCUSA must return your vehicle to you and waive all repossession fees, and update your Credit Report.

If this information is not included in your NOI, AND your vehicle was SOLD, then SCUSA must (by law), delete your trade line in your credit report, and waive the deficiency balance. By law they cannot collect the deficient balance if your vehicle was SOLD based off an invalid NOI letter.
