Bought a Gear Sport watch on dec. 26th 2018. Watch is advertised as swim ready and includes swim mode. Watch was submerged in 3 inches of water for about 15 seconds before bricking. Contacted samsung who explained that they will do nothing because the watch is water resistant to 50 meters and not water proof.
Explained during the hour call that this is false advertisement because their website advertises the watch as swim ready and the watch has a specific setting for swimming (which was on at the time). After that hour i was sent a ticket number and told i would get a shipping label. They would evaluate the watch but i would most likely be forced to pay for the repair.
After two weeks of waiting for the shipping label i called back to check the status and was told that they decided to ignore the request because they didnt want to warrenty the repair. After another solid hour on the phone and a threat to open a class action suit against them for false advertising (which they are facing overseas for the same issue with phones) they sent me a shipping label and explained they were going to evaluate the watch, but i would still most likely have to pay because the watch is not waterproof.
They then rudely hung up on me. The next day i called them back to ensure i was shipping it out correctly and was told that had i just shipped it out it would have been sent back unfixed because ticket numbers and watch numbers didnt exist in their system (i bought this from best buy brand new and sent them a picture of the box with all numbers).
They then went through the same rigamaroll about how i would most likely have to pay, which i responded by informing of legal rights and getting attornies involved. The didnt care. The manager i spoke to also didnt care. She transferred me to executive assistance knowing full well they were closed for the weekend and hung up on me.
They were to have called me back monday and never did. This company: false advertisement, deceiptful practice, failure to honor warrenty and because we are the little guy they transfer calls overseas to ignore issues. Have tried texting and responding back to any emails but they literally dont care... Someone please advise as to how this should be handled.
