IRS Garnished entire stimulus check even though there is a payment arrangement in place

When the bill for the Cares act passed in December, a provision was either left out or added that allowed the IRS to take your stimulus check for back taxes. The IRS at that time assured everyone that they would NOT do that, especially to people in the vulnerable population such as low income seniors. Well they lied. Even though my husband was on a payment arrangement with them for 2 years they took it. They perpetuated a lie from December saying they couldn't find him although they have no problem sending him a monthly bill and had his direct deposit information from the first round of checks. Then they told him to file a tax return for 2020, even though social security has been his only form of income since 2018.

They assured him that this was the way to get the stimulus money, never once saying they were going to take the money. He owes around 700. 500 of it because of the Obama care penalty for not having health insurance in 2017 when he lost his job. The new company did not pick up his benefits until 2018, and we could not even afford Obama Care then. Our household income is only 180% of the federal poverty level for 2021, so he more than qualifys for a waiver for the Offset Bypass Refund from the IRS. That information we just found out after he filed. The waiver has to be approved before you file, and since its so rare, difficult to get approved.

Of course you cannot get through to the IRS now, so the frustration mounts with each day. I have emailed the white house, my congresswoman and senators in Nevada, CNN, msnbc, several news outlets, but to no avail . if this 3rd package is passed without the proposal that stops the stimulus money from being taken by the IRS, the same thing will happen again, to more people, but I guess none of the people I tried to respond to me care.
