I rented a playstation 3 from Rent a center. IT was for 63 weeks at like 33.00 a week or so. I lost my job at about at about payment 38. I was going to give them their ps3 cause i coudlnt afford it. They started there strong arm and talking tough collection pratices. I decided to file a chapter 13 bankrupcy since i was falling behind on everything else. My father is a praticing bankrupcy law for over 30 yrs and he filed on my behalf. Rac was listed as a creditor. They come to my house when my 1 yr old son is sleeping and start knocking so hard knocking pics of the wall and ringing my door bell consistanly. I have had enough of this crap from them and confronted them on my front porch. The one manager there starting cussing out my wife which is not going to fly then start cussing at me. I told him he needs to contact my bankrupcy lawyer and that he is in violation of the automatic stay and they we are calling the cops cause you refuse to leave. He tells us are bk lawyer is wrong that you cant file bk on us. He continued on saying how he has worked at rac for 8 yrs and know the laws but he didnt know what a automatic stay was nice one. he continued on saying how he was going to take me to court etc. THe cops finally did arrive and made them leave after blocking our driveway. I cant belive that someone that has a high school diploma to get hired at rac would have more knowledge than someone with a law degree and been a praticing attorney since 1973. My lawyer did file a lawsuit against rac. I did win against them and the judge said that the state of Missouri considers this a "executory contract" and can be eliminated during bankrupcy. I got to keep my items and Rac was to pay 6k into my bankrupcy to disperse between my creditors. I later found out the manager got fired. These bozos bark is bigger than there bite it might cost you a ittle money but it was worth every bit to punch them right back in the mouth. DONT BE SCARED OF THEM

Seriously people. He stated that his father sued RAC, he never once said in his report that it occured in bankruptcy Court. If you read over Bankruptcy laws, you would see that any future income (this includes money you would receive from lawsuits) is to be taken and split between your creditors (unless it can be claimed under an exemption; which doesn't exist in chapter 13).
With that said, there is a few things that I find interesting in this report. First off, if you filed a Chapter 13, that is nothing more then a reorganization bankruptcy. That means that you are paying a fee to the courts and they in turn take that payment and divide it between all of your creditors. What you are talking about, sounds more like a Chapter 7 to me than anything else.
Secondly, I find it hard to believe that an RAC employee would stand there cursing at you until cops showed up. Don't get me wrong, I can't stand RAC, I go to Aaron's, however; with what business I have done with RAC in the past, they don't seem like the type of company to hire those 'type' of people.
Lastly, going back to my first topic, I highly doubt you were able to get $6000 from RAC for violating an automatic stay. Sure, you might have gotten the PS3 for free, however; in order to collect any money from such an issue, you (or your creditors) would need to have had damages caused by RAC's actions. About the only thing you would have been entitled to, is if they took it and you had to go to court and force them to return it. In such a case, you would still pretty much be limited to reimbursement of any attorney costs.

1. This guy is married to a woman with a Master's Degree in Education (which, according to him, is Nothing Special, and besides, he thinks teachers are all scumbags- tells you a lot about his marriage) but can't string together six words in a row without cursing or mangling the language,
2. This guy's dad is a bankruptcy lawyer who not only got him out of his RAC debt, but also got him a settlement- which he's either "enjoying" or went to pay his creditors, that part of the story changes from post to post,
3. This guy posts his story on a public website, but says he "doesn't have time" to post the court docket number,
4. ...then he says the court docket number is "none of our business." Again, after posting his pathetic story on a public website.
5. He then proceeds to lose his temper and call the people who simply don't believe his lame story "d****es" and "d****ebags." Married to a woman with a Master's Degree. Bankruptcy lawyer for a dad. Right. We'll be hearing about his brain surgeon brother tomorrow.
So.....which part of Lewis's posts don't make sense to you? They are clear as day to me. Lewis is the kind of kid who will show up at school in September and regale his friends with how he won all the sporting events at summer camp, and when skeptics ask to see the medals, ribbons and trophies, will tell you A) he lost them, B) he doesn't have time to bring them to school, and C) they aren't any of your business.
He's been kind of amusing for a while, but I think his entertainment value has worn out here. Maybe he'll pop back in to call me a a "d****ebag" once more, for old times' sake. :>)

The Judge is NOT going to order someone to pay someone else a penny, without those two parties having a contract between them. No Judge is going to attempt to make creditor A pay creditor B, just because creditor A violated(allegedly) a rule in the Bankruptcy Laws against you.

And you totally made my day by accusing ME of being a leech- even if you are telling the truth (you aren't, and we all KNOW you aren't) the idea that some loser who can't pay his bills and got his daddy to bail him out of his debts using the court system is calling a person who WORKS for a living and buys what he can AFFORD (and doesn't need a Playstation 3 because, well, I'm an ADULT) is just hysterical.

You sir (or lady) are truely what is wrong with this country right now. Obviously you had some credit "issues" when you had to buy this toy through RAC. Right there, you're telling us that you're not the brightest crayon in the box. Seriously, you chose to buy a toy at that cost/rate?
So you signed a contract for this toy and now all of a suddent it's RAC's fault you can't make the payments and guess what...they expect you to pay them back. Seriously, I agree with the threads here listed...you are full of *** about this whole "story".

You have been asked numorous times to provide the case information on this 6K judgment. Yet you not only have NOT done so, you refuse because you don't want to waste your time. No Case/Docket = No Proof = False post.
By the way in the OP you stated that the 6K was dispursed among your creditors. Yet in your last post you said you were enjoying the 6K. So which is it did the creditors get the money or did you?

They never did cause they waste the air i breath. They had there chance to get there money they couldn't file the paperwork to file a claim against me. They received the notice not to collect on this account and they ignored it. I really find it amusing that rent a center tried there hard ball collecting that they do and it backfired. I did enjoy my 6k dollars all at there stupidity.

I don't think anyone who posted here is clueless as to the automatic stay under the Bankruptcy Code (section 362(a)). I'm a little confused. It's not that I don't believe your story - it could happen. What I am curious about is the claim that your father is an attorney, and you can't even put together a coherent sentence. Your spelling is horrendous, and your grammar is attrocious. It would seem to me that an attorney's son would at least have 8th grade grammar skills. And the son of a bankruptcy lawyer who has such lousy credit that he has to use an RTO store ???? It just doesn't make sense.

I laughed at all the comical remarks at the above. You guys really dont realize the automatic stays stops everyone. I know Rac thinks there about god and there brainwashed employees. I would also like to add that i take care of my child so unless you know shut your trap. FOr the above idiot Robert, THe bankrupcy courts tend to get a little pissed when you violate a court order, thus why was your company such a idiots and coudlnt file a claim within 90 days of my filing. ONe of your idiot store managers didnt even know what a automatic stay was god what a such highly qualfied individual. When they visit your house 15 times after you filed bankrupcy there gonna be fines for it. SO finally i would like to say thank you Rac for my playstation 3 and giving me 6k after all the penalties cause of your stupidity.

please post the case number of your supposed victory over RAC. The property is theirs until you finish paying. If you declare bankruptcy you have two options: return the property and don't owe any more or reaffirm the debt and continue paying until it's yours. Your story doesn't hold water.

Robert- this guy has a one-year old child, got "behind in payments to creditors," but decided to rent a playstation and make a total of $1234 in payments before returning it- enough money to BUY THREE PLAYSTATIONS from Best Buy.
So your credit is in the toilet, you owe money everywhere, and you go out and RENT a GAME SYSTEM. Not a crib for your child, not an extra bed, a GAME SYSTEM.
I feel sorry for this guy's kid, I really do. His father is a total schmuck- and he has the gall to call RAC "idiots." This guy is going to be in and out of QuickCash stores for his entire life, blaming everyone for his idiotic choices except himself. "Winning" a settlement isn't going to do him a bit of good, because he thinks he "scored one for the little guy."
Yep, I feel sorry for this loser's kid- and anyone dumb enough to extend him credit. Heck, he didn't even know for sure how many payments he had left on the game system he had already paid for, several times over. Maybe it was 25 payments. Maybe it was 30. Whatever, it was only money he could have been putting into a college fund for his kid. Or at least some milk. Moron.

Well gee, except for the fact that you agreed to rent a Playstation for $33 a week for "something like 63 weeks" (total cost of rent: $2079. For a Playstation. Pure genius) you sound like you really have your act together there. You should be grateful that you lost your job and had to give it up, it probably saved you a ton of money.
Judging from your intelligence level, however, I'm sure you were quick to find other ways to toss cash down the toilet.
Seriously- you "needed" a PLAYSTATION so much that you were willing to fork over $132 a month to rent one? You aren't ready to be out on your own yet. You are right. A high school diploma and a clean urine test gives you a law degree in their eyes.
