My husband went to Rent A Center to rent a TV for his barber shop. There is two other guys that he works with and they agreed to split the payment three ways with him. Well, my husband was leaving work early and the guy he was working with did not have a key to the barber shop, so he lent him his key for the night. When he got into work the next morning, the TV was gone. So was the remote. But, the playstation and video's and other expensive items were still there. Well, the door was not kicked in. Matter of fact, the door was unlocked.

Well, my husband called the police and made a report. Then he called Rent A Center. They were fine with it at first. They told him that since it was stolen that he was not liable for it. Now, they are saying that since there was not forced entry, we have to continue paying for it. And that if we do not, they will take us to court. Is there any advice anyone can give me? I am at a loss right now. I do not want to pay for a tv that I do not have, and I don't feel that I am responsible for it since it was stolen and there was a police report filed for it.

Something does not sound right...

How is it your husband has a "barber shop" but needs to go to rent a center for a tv? This does not sound right. Is it a legit barber shop? You can buy a tv for a hundred bucks.

Deanna,

Unfortunately there are two problems here.

1) Unless your husband told them that it was going to be in the barber shop and listed the address of the barber shop on the rental order form, then he would immediately be in a breach of the initial contract which states at the bottom under "forbidden acts" that "You cannot pawn, pledge, mortgage, encumber, hock, or otherwise dispose of the property. You cannot move the property from your current residence without our consent." in which case he would, unfortunately be liable for the charges."

In the event that this was taken care of and he did tell them this information and they ok'd it, there is a far worse problem...

2) The liability waiver that your husband signed (you should have received a copy of it), does state that "Rent-A-Center agrees to waive your liability to Rent-A-Center if the property is damages, destroyed or lost through: 1. Lightening 2. Fire 3. Smoke 4. Windstorm 5. Theft and 6. Flood" The important part of this follows:

"As used here 'theft' means the criminal taking of the rental property from the residence shown in the Agreement by a person or persons making flonious entry through force or violence, as evidenced by visual marks or physical damage to the exterior of the premises at the point of entry. You must supply Rent-A-Center with a police report showing theft of or damage to the rental property."

Here is where your problem lies. The fact of the matter is that your husband should speak with or consider litigation with the other key holders of his establishment. As far as what you can do, the honest and unfortunate answer is nothing. It's only bad news that I have to offer and I apologize for that, but unfortunately the documents that Rent-A-Center has its customers sign are very airtight.

Somebody desperate enough to rent a TV from RAC probably does NOT have insurance on his/her business...

Your husband should be able to recover the loss of the tv through his insurance on the barbershop. Then he can simply use that money to pay off the tv. I don't see the problem. Altho' I agree that you should never deal with RAC. I'm curious why he needed to use RAC anyway. These days TV's are so inexpensive. I'm sure he didn't need a very big one for his shop and it would have been a business expense he could have claimed.

Deanna, I know how you feel. I had a camcorder that was stolen from my house. I had the "insurance" but as with you, since there was no forced entry the "waiver" as it was now called didn't cover it. My wife and I had paid off several accounts but it didn't do us any good. We bit the bullet and paid the early pay off amount. That gave us legal title to the camcorder and since there was a police report, if it was ever pawned it would come back to me.

Well you guessed it, it never showed up. Unfortunately with the way the contract is written if there is no forced entry the "insurance/waiver" is not going to cover you. You might want to consider some type of civil case against the person that borrowed the keys. Also I hope there was some type of written agreement on the splitting of fees so that the other two will pay their share. Good luck & keep us posted.
